Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Blonde Dolphin mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Blonde Dolphin is a personal relationship management application that allows you to:

• Store contact information for people you choose to add.
• Record notes, interactions, and memories associated with your contacts.
• Upload photos related to contacts and interactions.
• Set reminders and receive local notifications.
• Use AI-powered features to enhance and organise your notes.
• Generate briefings before meeting someone.

3. Account Registration

To use Blonde Dolphin, you must create an account using a valid email address and password, or by signing in with Apple. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

4. Acceptable Use

You agree to use Blonde Dolphin only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App in any way that violates applicable laws or regulations.
• Attempt to gain unauthorised access to the App, other accounts, or our systems.
• Use the App to store, transmit, or distribute malicious content.
• Reverse-engineer, decompile, or disassemble any part of the App.
• Use the App to collect or harvest personal data of others without their consent.
• Interfere with or disrupt the operation of the App or its infrastructure.

5. Your Content

You retain ownership of all content you create within the App, including notes, photos, and contact information ("Your Content"). By using the App, you grant us a limited licence to store, process, and transmit Your Content solely for the purpose of providing the service to you.

You are solely responsible for the accuracy and legality of Your Content. We do not monitor, review, or endorse user content.

6. AI Processing

Blonde Dolphin uses artificial intelligence (provided by Anthropic) to enhance notes and generate briefings. When you use these features, the text content of your notes may be sent to Anthropic's API for processing. By using AI-powered features, you consent to this processing.

AI-generated content is provided as a convenience and may not be perfectly accurate. You are responsible for reviewing and verifying any AI-enhanced content.

7. Intellectual Property

The App, including its design, code, branding, graphics, and all related intellectual property, is owned by Blonde Dolphin and is protected by copyright and other intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or other brand features.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. By using the App, you consent to the practices described in the Privacy Policy.

9. Account Deletion

You may delete your account at any time from within the App's Settings. Account deletion permanently removes all of your data, including contacts, notes, interactions, reminders, photos, and groups. This action cannot be undone.

10. Service Availability

We strive to keep Blonde Dolphin available at all times, but we do not guarantee uninterrupted or error-free service. We may temporarily suspend access for maintenance, updates, or other reasons without prior notice.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Blonde Dolphin and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising out of or in connection with your use of the App.

The App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Indemnification

You agree to indemnify and hold harmless Blonde Dolphin and its creators from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of the App or your violation of these Terms.

13. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Australia.
