1. Acceptance of terms
By downloading, installing, or using the Blonde Dolphin mobile application (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.
2. Description of service
Blonde Dolphin is a personal relationship app that lets you:
- Store contact information for people you choose to add.
- Record notes, interactions, memories, important dates and relationships for your contacts.
- Add photos to contacts and notes.
- Set reminders and receive notifications on your device.
- Use AI-powered features to tidy and organise your notes, generate briefings before you meet someone, and ask questions of your notes.
3. Account registration
To use Blonde Dolphin, you must create an account with a valid email address and password, or sign in with Apple or Google. You are responsible for keeping your account credentials confidential and for all activity that occurs under your account.
You agree to provide accurate, current, and complete information when you register and to keep it up to date.
4. Acceptable use
You agree to use Blonde Dolphin only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the App in any way that violates applicable laws or regulations.
- Attempt to gain unauthorised access to the App, other accounts, or our systems.
- Use the App to store, transmit, or distribute malicious content.
- Reverse-engineer, decompile, or disassemble any part of the App.
- Use the App to collect or harvest personal data of others without their consent.
- Interfere with or disrupt the operation of the App or its infrastructure.
5. Your content
You retain ownership of all content you create in the App, including notes, photos, and contact information (“Your Content”). By using the App, you grant us a limited licence to store, process, and transmit Your Content solely to provide the service to you.
You are solely responsible for the accuracy and legality of Your Content. We do not monitor, review, or endorse user content.
6. AI processing
Blonde Dolphin uses artificial intelligence provided by Anthropic to tidy and file notes, suggest reminders, dates and things to remember, write briefings, and answer questions about your notes. When you use these features, the relevant content is sent to Anthropic’s API for processing, as described in our Privacy Policy. By using AI-powered features, you consent to this processing. You can turn off note tidying at any time in Settings.
AI-generated content is provided as a convenience and may not always be accurate. You are responsible for reviewing and verifying any AI-generated content before relying on it.
7. Intellectual property
The App, including its design, code, branding, illustrations, and all related intellectual property, is owned by Blonde Dolphin and is protected by copyright and other intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or other brand features.
8. Privacy
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. By using the App, you consent to the practices described in the Privacy Policy.
9. Account deletion
You may delete your account at any time from the App’s Settings. Account deletion permanently removes all of your data, including contacts, notes, interactions, reminders, dates, photos, and groups. This cannot be undone. You can export a copy of your data from Settings before you delete your account.
10. Service availability
We strive to keep Blonde Dolphin available at all times, but we do not guarantee uninterrupted or error-free service. We may temporarily suspend access for maintenance, updates, or other reasons without prior notice.
11. Our responsibility to you
If you’re in Australia, the Australian Consumer Law gives you guarantees that can’t be excluded, including that our service will be provided with due care and skill. Nothing in these terms takes away those rights, or any other rights the law says can’t be taken away.
Beyond those rights, Blonde Dolphin is provided as it is. We work hard to keep it running and your notes safe, but we can’t promise it will always be available or free of errors, or that AI suggestions will always be right.
As far as the law allows, we aren’t responsible for loss or damage that:
- wasn’t reasonably foreseeable when you started using Blonde Dolphin;
- was caused by something outside our reasonable control, such as an outage at one of the services listed in our Privacy Policy; or
- was caused by you, for example by sharing your password.
Your notes matter, so keep a copy of anything important. You can export all of your data from the app at any time.
12. Claims caused by a breach of these terms
If you break these terms or the law while using Blonde Dolphin, and someone makes a claim against us because of it, you agree to cover our reasonable costs and losses from that claim. This doesn’t apply to the extent we caused or contributed to the problem.
13. Termination
We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately.
14. Changes to these terms
We may update these Terms from time to time. We will post the updated Terms on this page and update the “Last updated” date. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.
15. Which law applies
These terms follow the law of Victoria, Australia. If there’s ever a dispute, it will be settled in the courts of Victoria. If you live outside Australia, you keep any rights your own country’s consumer laws give you.
